(“Credique,” “we,” “us,” or “our”), a subsidiary of Credique LLC, headquartered at 8605 Santa Monica Blvd #92818, West Hollywood, CA 90069-4109, USA. These Terms and Conditions govern use of the Site and Services by residents of Canada, except residents of Québec, where the Services are not offered.
These Terms and Conditions (“Terms”) constitute a binding legal agreement between you and Credique Canada Inc. and govern your access to and use of the Site and Services. By using the Site or purchasing Services, you agree to these Terms and our Privacy Policy.
The Services consist of financial information products and tools offered on a recurring subscription (“Subscription Services”) or as one-time transactions (“Transactional Services”). Services may include access to your credit report, credit score, and related data provided by third-party providers such as TransUnion Interactive, LLC (collectively, the “Providers”). These materials (“Materials”) are for informational purposes only and not a substitute for professional advice. You acknowledge that Credique and its Providers shall not be liable for any inaccuracies or incompleteness in such Materials.
The Site and Services are available only to residents of Canada who have reached the age of majority in their province or territory. Access to or use of the Services outside Canada is prohibited where contrary to law. You represent that you are legally capable of entering into a binding contract and that you are a resident of Canada. The minimum age varies by province as specified on our Site. The Services are available only to residents of Canada, excluding residents of the Province of Québec. By accessing or using this Site, you represent and warrant that you are not a resident of Québec.
To use Subscription Services, you must provide valid payment information (credit/debit card, PayPal, or other accepted methods). By submitting your payment information, you authorize Credique to charge the applicable fees plus any applicable taxes on a recurring basis until you cancel. Charges may be processed in U.S. dollars. If applicable, discounts may be applied to offset exchange rate variations.
You may cancel your subscription at any time by calling 866-899-3175 . We do not provide prorated refunds for partial periods. Cancellation stops future recurring payments but may not terminate access to certain free features of the Site.
Your use of the Site is governed by our Privacy Policy , which describes how we collect, use, and share your personal information. By using the Site, you consent to such data practices.
All content on the Site, including text, graphics, software, and trademarks, is owned or licensed by Credique or its Providers and is protected by intellectual property laws. You may use such content solely for personal, non-commercial purposes. Unauthorized use may result in legal action.
You agree not to misuse the Site or Services, including by: (i) violating laws or regulations; (ii) attempting to gain unauthorized access to our systems; (iii) reproducing, copying, or reselling Services; or (iv) using the Site in a manner that could damage or interfere with its operation.
THE SITE, SERVICES, AND MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. CREDIQUE AND ITS PROVIDERS DO NOT WARRANT THAT THE SITE OR SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED.
To the fullest extent permitted by law, Credique, its affiliates, and Providers will not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from or related to your use of the Site or Services. In no event shall Credique’s total liability exceed the amount paid by you for Services during the one month preceding the event giving rise to the claim or CAD $19.95, whichever is less.
You agree to defend, indemnify, and hold harmless Credique, its affiliates, and Providers from any claims, losses, or expenses arising from your use or misuse of the Site or Services, or violation of these Terms.
Any dispute arising from or relating to these Terms shall be resolved by binding arbitration under the Arbitration Rules of the ADR Institute of Canada, Inc., in English. Arbitration will take place in Los Angeles, California, unless otherwise required by law. YOU AND CREDIQUE AGREE TO WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTIONS.
We reserve the right to suspend or terminate your access to the Site or Services at any time for violation of these Terms or for any reason at our discretion. Such termination may occur without notice or refund.
These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, excluding the laws of the Province of Québec and without regard to conflicts of law principles.
